                   AN ORDINANCE TO AMEND ORDINANCE NO. 6958, AS
                   AMENDED, KNOWN AS THE ZONING ORDINANCE, SO AS
                   TO REZONE A TRACT OF LAND LOCATED AT 7051
                   MCCUTCHEON ROAD, BEING ON THE NORTHEAST LINE OF
                   MCCUTCHEON ROAD SOUTHEAST OF LEE HIGHWAY FROM
                   R-4 SPECIAL ZONE TO C-1 HIGHWAY COMMERCIAL
                   ZONE, SUBJECT TO CERTAIN CONDITIONS.

              	   SECTION 1.  BE IT ORDAINED BY THE CITY COUNCIL OF THE
         CITY OF CHATTANOOGA, TENNESSEE, That Ordinance No. 6958, as
         amended, known as the Zoning Ordinance, be and the same is 
hereby
         amended so as to rezone:
               
                A tract of land located at 7051 McCutcheon Road,
                being on the northeast line of McCutcheon Road
                southeast of Lee Highway.  Part of lot 10, Church
                of God Addition No. 3, as shown by plat of record
                in plat book 43, page 145, ROHC; being part of the
                property described in deed book 3637, page 656,
                ROHC.  Said part of lot begins on the northeast
                line of McCutcheon Road 865.41 feet southeast of
                the intersection of the northeast line of
                McCutcheon Road with the southeast line of Lee
                Highway, thence northeast 365 feet parallel to the
                northwest line of lot 8, said subdivision, thence
                southeast 300 feet to the northwest line of said
                lot 8, thence southwest 365 feet with the northwest
                line of lot 8 to the northeast line of McCutcheon

                Road, thence northwest 300 feet with McCutcheon
                Road to the point of beginning.  Tax Map No.
                139P-C-7.8 (part).
               
               
         from R-4 Special Zone to C-1 Highway Commercial Zone..
              	   SECTION 2.  BE IT FURTHER ORDAINED, That this rezoning 

         shall be subject to the following conditions:
        
              1.   Subject to dedication of 30' of right-of-way from the 

                   centerline.
        
              2.   All existing easements are retained.
        
        
              	   SECTION 3.  BE IT FURTHER ORDAINED, That this 
Ordinance
         shall take effect two weeks from and after its passage as 
provided
         by law.
